Pursuant to the PENNSYLVANIA CLEAN STREAMS LAW, the PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION RULES and REGULATIONS, the SURFACE MINING CONSERVATION and RECLAMATION ACT and the BITUMINOUS MINE SUBSIDENCE AND LAND CONSERVATION ACT as amended, notice is hereby given that Emerald Coal Resources, LP, Emerald Mine, doing business at P.O. Box 1020, 158 Portal Road, Waynesburg, Pennsylvania 15370, has made application to the Pennsylvania Department of Environmental Protection to install fourteen (14) additional Ventilation Boreholes with a total surface area of 11.35 acres, in accordance with coal mining activity Permit No. 30841307. Emerald Coal Resources, LP requests the following variances located in Franklin Township, Greene County, Pennsylvania. A variance is requested for the access road to Borehole E1-1 to have activities within 100 feet of Stream 40465-L1c, an unnamed tributary (UNT) to a UNT to a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 3,000’ northeast of the intersection of SR 218 and Horseshoe Lane (T-511) and continuing upstream (northeast) for approximately 270’. A variance is requested for the access road to Borehole E1-1 to have activities within 100 feet of Stream 40465-L2, a UNT to a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 2,980’ northeast of the intersection of SR 218 and Horseshoe Lane (T-511) and continuing upstream (northeast) for approximately 113’. A variance is requested for the access road to Borehole E1-1 to have activities within 100 feet of Stream 40465-R2, a UNT to a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 2,720’ northeast of the intersection of SR 218 and Horseshoe Lane (T-511) and continuing upstream (east) for approximately 110’. Activities include installation of a crossing on Stream 40465-R2. A variance is requested for the access road to Borehole E1-1 to have activities within 100 feet of Stream 40465, a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 1,369 feet east of the intersection of SR 218 and Horseshoe Lane (T-511) and continuing upstream (south) for approximately 50 feet. Activities include installation of a crossing on Stream 40466 A variance is requested for Borehole E1-2 to have activities within 100 feet of Stream 40450-L3b1, a UNT to a UNT to a UNT to Sugar Run. The variance is located on the western side of Sugar Run Road (SR 2003), beginning approximately 918’ northwest of the intersection of SR 2003 and Cabin Road and continuing upstream (west) for approximately for 94’. Activities include installation of the borehole. A variance is requested for Borehole E1-2 to have activities within 100 feet of Stream 40450-L3b, a UNT to a UNT to Sugar Run. The variance is located on the western side of Sugar Run Road (SR 2003), beginning approximately 900’ northwest of the intersection of SR 2003 and Cabin Road and continuing upstream (southwest) for approximately for 116’. Activities include installation of the borehole. A variance is requested for the access road to Borehole E3-2 to have activities within 100 feet of Stream 40466, a UNT to a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 1,520’ east of the intersection of Smith Creek Road (SR 218) and Horseshoe Lane (T-511) and continuing upstream (southeast) for 570’. Additional variance is requested for this access road on Stream 40466 approximately 1,931’ southeast of the intersection of Smith Creek Road (SR 218) and Horseshoe Lane (T-511) and continuing upstream (southeast) for 131’. A variance is requested for the access road to Borehole E3-2 to have activities within 100 feet of Stream 40466-R3, a UNT to a UNT to a UNT to Smith Creek. The variance is located on the eastern side of Smith Creek Road (SR 218), beginning approximately 2,081’ southeast of the intersection of Smith Creek Road (SR 218) and Horseshoe Lane (T-511) and continuing upstream (northeast) for 514’. A variance is requested for the access road to Borehole E4-3 to have activities within 100 feet of Stream 40450, Sugar Run. The variance is located on the western side of Sugar Run Road (SR 2003), beginning approximately 2,170 feet west of the intersection of SR 2003 and Policz Road (T-497), and continuing upstream (southwest) for approximately 105 feet. Activities include installation of a crossing on Stream 40450. A variance is requested for the access road to Borehole E4-3 to have activities within 100 feet of Stream 40450-R4, a UNT to Sugar Run. Activities include installation of a crossing on Stream 40450. A variance is requested for the access road to Borehole E4-3 to have activities within 100 feet of Stream 40450-R2, a UNT to Sugar Run. The variance is located on the western side of Sugar Run Road (SR 2003), beginning approximately 3,130 feet west of the intersection of SR 2003 and Policz Road (T-497) and continuing upstream (west) for approximately 25 feet. A variance is requested for the access road to Borehole E5-1 to have activities within 100 feet of Stream 40461-R1, a UNT to Smith Creek. The variance is located approximately 375’ east of Smith Creek Road (SR 218) and 1,236’ north of the intersection of SR 218 and Orndorff Road (T-491). The variance continues upstream (east) for approximately 105 feet. Activities include installation of a crossing on Stream 40461-R1. A variance is requested for the access road to Borehole E5-2 to activities within 100’ of Stream 40473, a UNT to a UNT to Smith Creek. The variance is located on the north side of Orndorff Road (T-491), beginning approximately 3,413’ northeast of the intersection of Smith Creek Road (SR 218) and Orndorff Road (T-491) and continues upstream (northwest) for approximately 153’. A variance is requested for Borehole E3-3 to have activities related to access road construction and borehole installation within 100’ of Cabin Road. These activities are located off of Cabin Road, beginning approximately 3,380’ southwest of the intersection of Sugar Run Road (SR 2003) and Cabin Road (T-511) and continuing northeast for 100’. A variance is requested for Borehole E4-1 to have activities related to access road construction and borehole installation within 100’ of Horseshoe Lane. These activities are located off of an existing access road off of Horseshoe Lane, approximately 2,400’ south of the intersection of Smith Creek Road (SR 218) and Horseshoe Lane (T-511). The variance request begins at the end of this existing access road and continues southeast for approximately 225’. The proposed area can be found on the Location Map consisting of the Garards Fort U.S.G.S., 7 1/2 minute series topographic mapping. Pursuant to Pennsylvania Department of Environmental Protection’s Rules and Regulations, Surface Mining Conservation and Reclamation Act, Coal Refuse Disposal Control Act, the Pennsylvania Department of Environmental Protection Rules and Regulations, and Pennsylvania Clean Streams Law, notice is hereby given that Cumberland Coal Resources L.P. of 158 Portal Road, P.O. Box 1020, Waynesburg, PA 15370, has submitted an application to the Department of Environmental Protection, District Mining Operations, for the renewal of its existing Coal Refuse Disposal Permit and the related NPDES Permits for the Cumberland Mine No. 1 - Coal Refuse Disposal Facility No. 1. The current permit (No. 30743711) was issued on December 9, 1985 and will expire on December 9, 2010. This renewal does not contain revisions to the existing operation. The receiving streams for the permit are Patterson Run, Whiteley Creek and an unnamed tributary to Whiteley Creek.
The operation/permit area is 152 acres and is located in Greene County, Whiteley Township, Pennsylvania, approximately 1.7 miles west of the intersection of Kirby Road (LR 30014) and Mount Morris Road (State Route 19) and approximately 0.25 miles north-northeast of the intersection of Kirby Road (LR 30014) and Patterson Run Road. Three NPDES discharge points are associated with the permit; Discharge Points 001, 014 and 016. The NPDES Discharge Point 001 is located approximately 1,200 feet southwest of the intersection of Kirby Road (LR 30014) and Patterson Run Road. The NPDES Discharge Point 014 is located approximately 700 feet southeast of the intersection of Kirby Road (LR 30014) and Patterson Run Road. The NPDES Discharge Point 016 is located approximately 30 feet southeast of the intersection of Kirby Road (LR 30014) and Patterson Run Road.. The site can be found on the Oak Forest U.S.G.S. 7 1/2 minute topographic map, 9.7 inches north and 3.3 inches west of the bottom, right-hand corner of the printed area of the map.

Pursuant to the Pennsylvania Clean Streams Law. the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended. notice is hereby given that Consol Pennsylvania Coal Company LLC, 1525 Pleasant Grove Road: Claysville. PA 15323 is making application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit (CMAP) No. 30841316 for the Bailey Mine.
The proposed revision includes the changing the use of 2538.59 acres in the existing underground permit area and subsidence control plan area from underground development mining to full extraction longwall mining.
The proposed revisions are in Richhill & Morris Townships. Greene County. and can be found on the Rogersville. PA U. S. Geological Survey 7.5 minute topographic maps and mapping provided in the permit application. This area can be described as follows:
The revision to the permit area and subsidence control plan area for longwall mining begins at a point approximately 625 feet southeast of the intersection of Rush Run road (SR 4009) and Crouse road (T392) then approximately 18250 feet southeast to a point approximately 1125 feet southeast of the intersection of Johnson Hill road (T422) and Patterson Creek road (T581) then approximately 6625 feet northeast to a point approximately 875 feet northeast of the intersection of State Route 18 and Tripp Hill road (SR 4012) and then approximately an 16500 feet northwest to a point approximately 3500 feet northeast of the intersection of Power School road (T603) and Hewitt Ridge road (T613) and then approximately 5500 feet southwest to a point 2125 feet southwest of the intersection of Power School road (T603) and Hewitt Ridge road (T613) and then approximately 1750 feet northwest to a point 750 feet northeast of Rush Run Road (SR 4009) and Crouse road (T392) and then approximately 1155 feet southwest to the point of origin.
The proposed revision requests approval to perform minor forms of stream restoration as may be necessary for streams located within the proposed revision area. In general. all streams within the following defined portion of the proposed subsidence control plan boundary where minor forms of stream restoration may be necessary: (as outlined on Exhibit 6.1 Map). Streams located within the proposed full extraction area include Unnamed Tributary (40565) to Browns Creek Unnamed Tributary to Patterson Creek (40561) and Patterson Creek (40547). The potential subsidence and subsequent post mining stream channel grading and restoration are predicted based on the results of a subsidence deformation model applied to pre-mining stream channel profiles developed in the field. These streams have a gradient less than or equal to 2% but has no anticipated pooling areas greater than or equal to 1 foot so pooled restoration activities are not proposed for these streams. All other Tributaries have gradients greater than 2% within the proposed full extraction area and pooled stream restoration activities are not anticipated for these streams. Potential restoration activities in these areas may include heave removal. streambed grouting. fracture sealing with bentonite, stream habitat restoration. installation of habitat enhancement structures. stream bank stabilization. re-vegetation and flow augmentation. Once mining is completed, the affected stream reaches and restoration plans will be re-evaluated with the Department and the restoration plans will be implemented as necessary. Stream variances are not requested.

Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consolidation Coal Company, doing business at 1 Bridge Street, Monongah, WV 26554, has made application to the Pennsylvania Department of Environmental Protection for an amendment to the Blacksville No. 2 Deep Mine, CMAP No. 30841312 and NPDES No. PA0013790. The amendment will include the addition of an air ventilation shaft support facility, erosion and sediment control structures and a NPDES Discharge Outlet. Twenty four and a half (24.5 acres are being added to the permit surface facilities. The site will be named the Roberts Run Air Shaft Site.
The proposed shaft site permit area lies within Gilmore Township of Greene County. The location of the Roberts Run Air Shaft Site is as follows: Approximately three quarters (3/4) of a mile west of the intersection of Roberts Run Road (TR-379) and Blockhouse Run Road (TR404), along the north side of Roberts Run Road. The site can be specifically located at Latitude North 39¡ 45’ 29” and Longitude West 80¡ 19’ 50”. The proposed area can be found on the Holbrook, PA U.S.G.S. 7.5’ series topographic map.
The permit revision application will include the addition of an NPDES stormwater discharge outlet. The outlet is located at Latitude 39¡ 45’ 26” and Longitude 80¡ 19’ 47”. The proposed operation will discharge drainage water into an unnamed tributary to Roberts Run, along the north side of Roberts Run Road, approximately three thousand two hundred eighty feet (3,280’) west of the intersection of Roberts Run Road (T-379) and Blockhouse Run Road (T-404).
This application includes a request for a variance to operate within one hundred feet (100’) of the unnamed tributary to Roberts Run (1R). Specific activities within the variance area include the construction of a collection ditch and silt fence. The variance area begins approximately four thousand feet (4,000’) west of the intersection of Roberts Run Road (TR-379) and Blockhouse Run Road (TR-404) and continues north along the east side of the unnamed tributary for approximately four hundred fifty feet (450’).
This application also includes a request for a variance to operate within one hundred feet (100’) of the unnamed tributaries to Roberts Run (0R and 1R). Specific activities within the variance area include the construction of an access road, sediment trap, level spreader, road ditch, diversion ditch and silt fence. The variance for the unnamed tributary to Roberts Run - 0R begins approximately two thousand eight hundred forty feet (2,840’) west of the intersection of Roberts Run Road (TR-379) and Blockhouse Run Road (TR-404). This variance begins approximately 500 feet north of the intersection with Roberts Run and extends northerly for approximately 375 feet upstream. The variance for the unnamed tributary to Roberts Run - 1R begins approximately two thousand eight hundred forty feet (4,025’) west of the intersection of Roberts Run Road (TR-379) and Blockhouse Run Road (TR-404). The variance for the Unnamed Tributary to Roberts Run - 1R begins approximately 500 feet upstream of the intersection with Roberts Run and extends northerly for approximately 230 feet upstream. A variance to be within one hundred feet (100’) of the right-of-way of Roberts Run Road (TR-379) is being requested. The variance area is located approximately two thousand eight hundred forty feet (2,840’) west from the intersection of Roberts Run Road (TR-379) and Blockhouse Run Road (TR-404). The variance continues for nine hundred eighty feet (980’) in a westerly direction, along the north side of TR-379. Specific activities within the variance area include the construction of an access road and the construction of erosion and sedimentation controls.

LEGAL NOTICE: Cumberland Coal Resources, Cumberland Mine
Permit No. 30831303, Whiteley Twp, Greene County
Stream Variances, State Roadway Variance, and Township Roadway Variance

Pursuant to the Pennsylvania Clean Stream Law, the Pennsylvania Department of Environmental Protection rules and regulations, the Surface Mining Conservation and Reclamation Act and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Cumberland Coal Resources, LP, doing business at 158 Portal Road, Box 1020, Waynesburg, PA 15370, has made application to the Pennsylvania Department of Environmental Protection to allow for stream variances, a state roadway variance, and a township roadway variance for the Cumberland Mine, Permit, No. 30831303.

The proposed project area will add additional surface acreage to the currently permitted mine area. The site is located in Whiteley Township, Greene County, PA and consists of a 20 foot wide corridor from the Cumberland No. 6 Shaft facility on SR 2003 (Patterson Run Road) and extending eastward approximately 9,300 feet through largely wooded areas, crossing SR 2003 and township road T-540 (Zimmerman Road), and ending at Cumberland’s Slurry Impoundment Number One. The permit revision adds additional surface acreage totaling 2.90 Acres to the Cumberland Mine permit as required for construction and operation of a proposed fourteen inch water line to convey mine water from Number 6 Shaft site to Slurry Impoundment Number One. The Oak Forest, Pa. USGS quadrangle map covers the area of the proposed additional acreage and variance areas.

The application includes a request for variance area for Patterson Run, six unnamed tributaries to Patterson Run, Township Road T-540, and State Route 2003, for installation of a 14 inch waterline to facilitate the Cumberland underground mine operations.

It is proposed to bore below State Route 2003, however surface operations including excavation and backfilling for the waterline trench and bore pits are proposed within 100 feet of State Route 2003, therefore a variance is required. The variance request for State Route 2003 is centered at the proposed roadway crossing located approximately 4080 LF north of the intersection of State Route 2003 and Township Road T-540. The waterline will be bored below the roadway pavement therefore no disturbance of State Route 2003 is proposed.

An open-cut trench is proposed to cross Township Road T-540. The Variance request for Township Road T-540 is centered at the proposed roadway crossing located approximately 2300 LF north of the intersection of T-540 and SR 2003.

The stream variance requests for Patterson Run and six unnamed tributaries to Patterson Run begin just west of SR 2003. The stream variance requests are as follows:

o 630 LF of an unnamed tributary to Patterson Run originating approximately 1080 feet northwest of where the proposed waterline crosses SR 2003,

o 200 LF of Patterson Run for a stream crossing, located
approximately 450 feet northwest of where the proposed
water line crosses SR 2003,

o 200 LF of a second unnamed tributary to Patterson Run,
for another stream crossing, located about 200 feet west
of the SR 2003 crossing,

o 260 LF of a third unnamed tributary to Patterson
Run, for another stream crossing, located about 1250
feet southeast of the SR 2003 crossing,

o 200 LF of a fourth unnamed tributary to Patterson
Run, for another stream crossing, located approximately
320 feet west of the T-540 crossing,

o 1200 LF of a fifth unnamed tributary to Patterson Run,
which runs parallel to the proposed waterline
approximately 180 feet south of the T-540 crossing,

o 410 LF of a sixth unnamed tributary to Patterson Run,
located north of the fifth unnamed tributary and west of
T540 approximately 80 feet north of the T-540 crossing.

Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, 1525 Pleasant Grove Road; P. O. Box J; Claysville, PA 15323 is making application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit (CMAP) No. 30841316 for the Bailey Mine.
The proposed revision adds approximately 17.5 acres of surface permit area for construction of the 15I-9I Waterline and Powerline. The facility will be located in Richhill Township and Aleppo Township, Greene County, Pennsylvania and is located on the New Freeport, PA U.S. Geological Survey 7.5 minute topographic map. The proposed permit area begins approximately 0.35 miles northeast of the intersection of S.R. 3018 (Behm Road) and S.R. 3001 (Aleppo Road) and extends approximately 7,600 feet north. The permit area width is approximately 100 feet. The proposed permit revision includes construction of a 7,700 foot waterline and powerline and erosion and sedimentation control facilities.
The application includes a request for variance to encroach within 100 feet of the right of way for a section of Riggs Road (T-505) beginning approximately 1.05 miles northeast of the intersection of Riggs Road and S.R. 3001 (Aleppo Road) and continuing 100 feet to the northeast. The road variance is required for the construction of the waterline and powerline and erosion and sedimentation control facilities.
A stream variance request is proposed for Unnamed Tributary 8-32566 to South Fork Dunkard Fork beginning approximately 6,000 feet upstream of its confluence with South Fork Dunkard Fork (approximately 1.05 miles northeast of the intersection of Riggs Road and S.R. 3001) and continuing 100 feet upstream. The stream variance is required for site grading, waterline crossing installation, and installation of erosion and sedimentation control facilities.

Blast Notice: Opfermann Mine, SMP #63090102

Opfermann Mine NOTICE Neiswonger Construction, 17592 Route 322, Strattanville, PA 16258 proposes to conduct overburden blasting in compliance with all state and federal laws (as written within the “Surface Mining Control and Reclamation Act of 1977”) at its surface coal mining operations located in Somerset Township, Washington County, known as the Opfermann Mine, SMP #63090102. The permit is on lands now or formerly of Robert & Roberta Opfermann and Wilbert & Beverly Obringer. Blasting is proposed between the hours of sunrise and 8:00 AM, 8:00 AM to 12:00 Noon, 12:00 PM to 4:00 PM, and 4:00 PM to sunset everyday except Sunday from June 2010 through June 2011. Warning signs will be placed at every entrance to the operation and three (3) - five (5) second signals of sufficient power to be heard Yo mile from the blast site, will be sounded one (1) minute but no more than 2 minutes before blast will be blown. One prolonged ten second signal of sufficient power to be heard Yo mile from the blast site will be blown as an all clear signal. Rain, lightening, or other atmospheric conditions, or operator, or public safety, are considered emergency situations and may require unscheduled detonation. If this occurs, identical warning and precaution measures will be taken. 7-21
